Privacy Policy

The controller responsible for data processing on this website is:
André Geisler Immobilien
Owner: André Geisler
Droysenstraße 5
10629 Berlin, Germany
Phone: +49 151 55471111
E-mail: ag-immobilien@berlin.de
If you have any questions about data protection, you can contact me at any time using these details.
2. Data protection at a glance
The protection of your personal data is important to me. I process your data exclusively in accordance with the statutory provisions, in particular the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and the German Telecommunications Digital Services Data Protection Act (TDDDG).
I mainly collect personal data when you provide it to me yourself, for example via a form, by e-mail or by phone. When you visit the website, technically necessary data is also recorded automatically (see section 3).
This website does not use any analytics or tracking tools, no advertising cookies and does not embed content from external providers. Fonts, images and scripts are loaded exclusively from my own server.
3. Hosting and server log files
This website is hosted by Hetzner Online GmbH, Industriestraße 25, 91710 Gunzenhausen, Germany. The servers are located in Germany. A data processing agreement pursuant to Art. 28 GDPR has been concluded with Hetzner. Further information can be found in Hetzner's privacy policy at https://www.hetzner.com/de/rechtliches/datenschutz
When you access the website, information transmitted by your browser is recorded automatically: IP address, date and time of access, page accessed, amount of data transferred, browser type and version, operating system and the previously visited page (referrer). This data is technically required to deliver the website and to ensure its stability and security. It is not combined with other data sources.
The legal basis is Art. 6(1)(f) GDPR. My legitimate interest lies in providing the website securely and without errors. The log files are stored only for as long as necessary for these purposes and are then deleted.
4. Cookies
This website does not set any cookies for analytics or advertising purposes. Where technically necessary data is stored in your browser (for example for language selection or for logging in to the administration area), this is done on the basis of Section 25(2) No. 2 TDDDG and Art. 6(1)(f) GDPR. No consent is required for this.
For the app function (using this website as an app on your home screen), your browser also stores technically necessary files: a small program (service worker), a notice page for when there is no internet connection, and logos, fonts and images of this website. No personal data, form entries or exposés are stored in the process. Here too, the legal basis is Section 25(2) No. 2 TDDDG and Art. 6(1)(f) GDPR. You can delete these files at any time via your browser settings.
5. SSL/TLS encryption
For security reasons, this website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser's address bar and by the padlock symbol. Data you send to me, for example via a form, therefore cannot be read by third parties.
6. Contact via form, e-mail or phone
If you contact me via a form on this website (contact, sell your property, search request), by e-mail or by phone, I process the data you provide (for example name, e-mail address, phone number, details of the property and your message) in order to handle your enquiry and answer any follow-up questions.
The legal basis is Art. 6(1)(b) GDPR insofar as your enquiry relates to a contract or pre-contractual measures. In all other cases, processing is based on my legitimate interest in handling enquiries (Art. 6(1)(f) GDPR).
Your data remains with me until you request its deletion or the purpose of storage no longer applies, for example once your enquiry has been dealt with. Statutory retention periods remain unaffected.
7. Exposé requests and proof of brokerage
If you request an exposé via my website, I process your details (title, name, address, phone number, e-mail address and the property requested) as well as your declarations regarding the right of withdrawal, the proof-of-brokerage and commission agreement and data protection, each with date and time.
To confirm your e-mail address, you will first receive an e-mail with a confirmation link (double opt-in). The exposé is only sent after you have confirmed.
The legal basis is Art. 6(1)(b) GDPR. Storing your declarations also serves as proof of the conclusion of the contract and of my claim to commission (Art. 6(1)(f) GDPR). This data is stored for three years from the end of the year of the request and then deleted automatically, provided that no contract has been concluded and no statutory retention obligations apply.
8. Enquiries via property portals
I also offer properties on property portals, in particular ImmoScout24 (Immobilien Scout GmbH), Immowelt (AVIV Germany GmbH) and Kleinanzeigen (Kleinanzeigen GmbH). The use of these portals is subject to their own privacy policies.
If you contact me via a portal, I receive the data you entered there, for example name, e-mail address, phone number, your message and, where applicable, details of your search. I process this data to answer your enquiry, send you property information and arrange viewings. The legal basis is Art. 6(1)(b) GDPR.
If no contract is concluded, I delete the data at the latest after the statutory limitation period for possible claims has expired, usually three years from the end of the year of the enquiry, unless statutory retention obligations apply.
9. Spam protection (captcha)
To protect my forms against automated requests, I use my own verification procedure (captcha) that runs on my server. No data is transmitted to third parties. The legal basis is Art. 6(1)(f) GDPR. My legitimate interest lies in the security of my website.
10. Disclosure as part of the brokerage
Where necessary for the brokerage, I pass on your data to the respective owner or seller, to the property management and to the notary instructed (Art. 6(1)(b) GDPR). Your data is not passed on to other third parties unless I am legally obliged to do so.
11. Obligations under the Money Laundering Act
As an estate agent, I am obliged under the German Money Laundering Act (GwG) to identify my contractual partners before a purchase contract is concluded and to record details from an official identity document for this purpose. The legal basis is Art. 6(1)(c) GDPR in conjunction with Sections 10 et seq. GwG. The documents are kept for five years in accordance with Section 8(4) GwG and then deleted.
12. Google Business Profile
I maintain a business profile on Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). If you view this profile, leave a review or contact me through it, Google's privacy policy applies. I process messages and reviews that I receive via the profile in order to respond to your request (Art. 6(1)(b) or (f) GDPR).
13. Social media profiles
On this website I link to my profiles on Facebook and Instagram (Meta Platforms Ireland Limited), LinkedIn (LinkedIn Ireland Unlimited Company), YouTube (Google Ireland Limited), TikTok (TikTok Technology Limited) and X (Twitter International Unlimited Company). These are simple links. No data is transferred to these providers when you visit this website.
Only when you click a link will you be taken to the respective provider's page, where its privacy policy applies. For my pages on Facebook and Instagram, I am jointly responsible with Meta for certain processing operations (Art. 26 GDPR). I process messages you send me via these profiles in order to respond to your request (Art. 6(1)(b) or (f) GDPR).
14. Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data remains with me until the purpose of processing no longer applies. If you submit a justified request for deletion or withdraw your consent, your data will be deleted unless there are other legally permissible reasons for storing it, for example retention periods under tax or commercial law. In that case, the data will be deleted once these reasons no longer apply.
15. Your rights
Within the framework of the statutory provisions, you have the right at any time to:
- access to your stored data, its origin, recipients and the purpose of processing (Art. 15 GDPR)
- rectification of inaccurate data (Art. 16 GDPR)
- erasure of your data (Art. 17 GDPR)
- restriction of processing (Art. 18 GDPR)
- data portability (Art. 20 GDPR)
- withdraw any consent given with effect for the future (Art. 7(3) GDPR); the lawfulness of processing carried out before the withdrawal remains unaffected
Simply contact me using the details given in section 1.
16. Right to object under Art. 21 GDPR
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data. This also applies to profiling based on these provisions. After an objection, I will no longer process your data unless I can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (Art. 21(1) GDPR).
If your data is processed for direct marketing purposes, you have the right to object at any time to processing for this purpose. This also applies to profiling insofar as it is related to such direct marketing. After your objection, your data will no longer be used for direct marketing (Art. 21(2) GDPR).
17. Right to lodge a complaint
You have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your data infringes the GDPR. The authority responsible for me is the Berlin Commissioner for Data Protection and Freedom of Information (www.datenschutz-berlin.de). This right exists without prejudice to any other administrative or judicial remedy.
18. Last updated
This privacy policy was last updated in September 2026. I will adapt it if the website or the legal requirements change. In case of doubt, the German version shall prevail.
